Terms of Service

The agreement between you and Endzah when you use our platform: written as plainly as possible. If anything is unclear, reach out via Support.

Using the platform

Tickets & payments

  • Tickets are sold on behalf of organizers
  • Ticket prices include a 6% + J$120 per ticket service fee and 4% of order + J$56 per order for card processing unless the organizer absorbs them.
  • Card payments are processed by PowerTranz
  • Refunds follow the organizer's policy

If you organize events

  • Provide accurate event details
  • Honor sales and handle refunds promptly
  • Paid plans are prepaid; auto-renew is optional

What we don't do

  • Run or insure events ourselves
  • Guarantee refunds on cancelled events
  • Guarantee uninterrupted service

Acceptance of Terms

By accessing and using Endzah ("the Platform", "we", "us", "our"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our services. These Terms apply to all users, including event attendees, organizers, artists, and venue owners.

Definitions

"User" refers to any individual or entity accessing the Platform. "Organizer" refers to users who create and manage events. "Attendee" refers to users who purchase tickets or attend events. "Event" refers to any gathering, experience, or occasion listed on the Platform, including concerts, festivals, conferences, workshops, church services, sporting events, fundraisers, community events, educational events, and similar occasions. "Content" includes all text, images, videos, and other materials posted on the Platform.

User Accounts

To use certain features of Endzah, you must create an account. You are responsible for

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and current information
  • Notifying us immediately of any unauthorized use
  • Ensuring you are at least 18 years old (or have parental consent if under 18)

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Organizer Responsibilities

If you create events as an Organizer, you agree to

  • Provide accurate event information (date, time, location, capacity, pricing)
  • Honor all ticket sales and provide the advertised event experience
  • Comply with all applicable laws and regulations
  • Obtain necessary permits, licenses, and insurance
  • Handle refunds and cancellations according to our Refund Policy
  • Not sell tickets for events you do not have authority to sell
  • Maintain appropriate security and safety measures at events
  • Respond promptly to attendee inquiries and complaints

Organizers are solely responsible for their events and any issues arising from them.

Ticket Sales and Purchases

Ticket Sales

  • Tickets are sold on behalf of Organizers, not by Endzah directly
  • All ticket sales are final unless otherwise stated in the event refund policy
  • Ticket prices are set by Organizers and may include service fees
  • We reserve the right to cancel tickets if fraud is detected
  • Resale of tickets may be restricted by Organizers

Purchases

  • By purchasing a ticket, you agree to attend the event as described
  • You must present valid identification and your ticket (QR code) at the event
  • If you lose access to your account or confirmation email, contact support@endzah.com. We will help you access tickets still active in our system. We cannot restore tickets that have been transferred away, refunded, voided, or invalidated after check-in
  • Refunds are subject to the Organizer's refund policy and our Refund Policy

Ticket Transfers

Some events allow ticket transfers when the Organizer enables them for that listing.

  • Only the current ticket holder may start a transfer from My tickets
  • Transfers are completed when the recipient claims the ticket with the email address provided by the sender
  • Transfers may be subject to deadlines set by the Organizer and may not be available after check-in or after the event starts
  • The Organizer may restrict re-transfers. Endzah does not guarantee that any event will allow transfers
  • Transfers do not change the refund policy for the original purchase. Refunds, if any, follow the event policy and our Refund Policy

Payments and Fees

Payment Processing

  • Card payments for tickets and organizer plans are processed by PowerTranz
  • Endzah does not store full card numbers or card security codes
  • All payments are processed securely
  • You authorize us to charge your payment method for ticket purchases and organizer plan payments you confirm
  • Endzah may support ticket purchases in JMD or USD depending on the event listing. Amounts and currency are shown before you pay
  • Card processing is 4% of order + J$56 per order at checkout to cover bank and card fees
  • When organizers absorb fees, the service fee is 6% + J$120 per ticket and card processing is 4% of order + J$56 per order, deducted from ticket revenue.

Refunds

  • Refund eligibility is determined by the Organizer's refund policy
  • Refunds may take 5-10 business days to process after organizer approval
  • Service and processing fees are generally non-refundable unless required by law or stated on the event listing
  • Event cancellations by Organizers may result in refunds only when the Organizer offers them under the event policy
  • No-shows are not eligible for refunds

Chargebacks

  • Contact support@endzah.com before initiating a chargeback so we can help resolve the issue
  • Filing a chargeback for a valid charge, or abuse of the dispute process, may result in account suspension or other restrictions
  • Chargebacks on ticket orders may be referred to the event Organizer. Organizers are responsible for their events and related buyer disputes

Organizer Plans and Billing

Endzah offers optional organizer plans, including Free, Pro, and Growth. Plan features and availability may change over time.

Pricing

  • Current pricing is displayed on the pricing page and at checkout before purchase

Billing

  • Paid plans are prepaid for the billing period you select (monthly or annual)
  • Each plan payment covers one billing period unless stated otherwise at checkout
  • By default, plans do not renew automatically. You may turn on automatic renewal at checkout or later from Plans & billing
  • If automatic renewal is on, we may charge your saved payment method before your current period ends to keep your plan active. You can turn automatic renewal off at any time from Billing. Access continues until the end of the paid period
  • You may cancel at period end from Plans & billing. Cancellation stops future charges but does not refund the current period unless required by law or stated otherwise in writing
  • Downgrades between paid plans may take effect at your next renewal date, as shown in the product
  • Promotional or trial access, when offered, is described at signup or checkout and may convert to a paid plan unless you cancel before the offer ends

Subscription fees are separate from ticket sales. Ticket refund rules do not apply to organizer plan payments.

Event Cancellations, Postponements and Reschedules

Organizers are responsible for their events, including cancellations, postponements, reschedules, and changes to date, time, venue, or other event details.

  • If an Organizer cancels or reschedules an event, Endzah will send notifications when we receive updated information from the Organizer
  • Unless required by law or stated on the event listing, Endzah does not guarantee refunds when an event is cancelled or rescheduled. Refund treatment follows the event refund policy and our Refund Policy
  • Endzah is not responsible for Organizer decisions about whether to offer credits, transfers, or refunds for rescheduled events

Prohibited Activities

You agree NOT to

  • Use the Platform for any illegal purpose
  • Create fake or fraudulent events
  • Sell counterfeit or invalid tickets
  • Scrape, copy, or harvest data from the Platform
  • Interfere with Platform operations or security
  • Impersonate other users or entities
  • Post false, misleading, or defamatory content
  • Violate intellectual property rights
  • Spam or send unsolicited communications
  • Use automated systems to purchase tickets (bots)
  • Engage in ticket scalping or unauthorized resale
  • Create multiple accounts to circumvent restrictions

User Content and Intellectual Property

User Content

  • You retain ownership of content you post
  • By posting content, you grant us a license to use, display, and distribute it on the Platform
  • You represent that you have the right to post the content
  • We may remove content that violates these Terms or is objectionable

Platform Content

  • All Platform content (design, logos, software) is owned by Endzah
  • You may not copy, modify, or distribute Platform content without permission
  • Endzah trademarks and logos are protected intellectual property

Disclaimers and Limitations

Service Availability

  • We provide the Platform "as is" without warranties
  • We do not guarantee uninterrupted or error-free service
  • We are not responsible for third-party services (payment processors, venues)

Event Disclaimer

  • Endzah is not responsible for events created by Organizers
  • We do not endorse or guarantee the quality of events
  • Attendees attend events at their own risk
  • We are not liable for injuries, damages, or losses at events

Limitation of Liability

  • Our liability is limited to the amount you paid for tickets
  • We are not liable for indirect, incidental, or consequential damages
  • Some jurisdictions do not allow limitation of liability, so these limits may not apply to you

Force Majeure

Endzah is not liable for delays or failures caused by events outside our reasonable control, including natural disasters, government actions, utility or network outages, internet disruptions, labor disputes, or failures of third-party providers.

Organizers remain responsible for decisions about their events during disruptions, including whether to cancel, reschedule, or offer refunds.

Indemnification

You agree to indemnify and hold harmless Endzah, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any law or rights of others
  • Content you post or events you create
  • Your events or ticket sales

Termination

We may terminate or suspend your account at any time for

  • Violation of these Terms
  • Fraudulent activity
  • Legal or regulatory requirements
  • Extended inactivity

Upon termination

  • Your right to use the Platform ceases immediately
  • We may delete your account and content
  • Outstanding obligations remain in effect
  • Refunds will be handled according to our Refund Policy

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via

  • Email to registered users
  • Notice on the Platform
  • Updated "Last Modified" date

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Platform.

Governing Law and Disputes

Governing Law

  • These Terms are governed by the laws of Jamaica
  • Any disputes will be resolved in Jamaican courts

Dispute Resolution

  • We encourage resolving disputes through direct communication
  • For disputes under J$50,000, we may offer mediation
  • Class action waivers may apply as permitted by law
